Please read these Terms carefully before using CapsuleHunt. By using the service, you agree to be bound by these Terms.

1. Introduction

These Terms of Service (the "Terms") govern your use of the CapsuleHunt service (the "Service"), including all features, functionality, and content provided by Everbundance ("we," "us," "our," or "Company").

By accessing or using CapsuleHunt, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the Service.

1.1 Scope of Application

These Terms apply to all users ("User," "you") who access or use the Service, regardless of their country of residence or the device used to access the Service.

1.2 Effective Date and Amendments

These Terms are effective as of July 17, 2026. We may amend these Terms in response to changes in applicable law, service content, or other circumstances. Please refer to Section 11.1 for the amendment procedure.

1.3 Fees

The Service is currently provided free of charge in its entirety. If we introduce paid plans in the future, we will establish and announce the fees, payment methods, and cancellation terms in advance in accordance with applicable law.

2. About the Service

2.1 Overview

CapsuleHunt is a crowdsourced platform that provides location information and inventory status for gashapon (capsule toy) vending machines primarily in Japan. The Service relies on data voluntarily submitted by the community to deliver near-real-time inventory information.

2.2 Features

The Service includes the following features:

Search by name or location: Find vending machines and stores by keyword, series name, or area
View crowdsourced inventory data: Browse user-submitted inventory statuses such as "In Stock," "Sold Out," and "Discontinued"
GPS-based nearby search: Locate vending machines near your current position using GPS
Favorites: Save specific stores, series, and IPs to your favorites list
Inventory notifications: Receive push or email notifications when inventory is updated for favorited items

2.3 Nature of Crowdsourced Data

The majority of inventory and store information displayed on the Service is crowdsourced data voluntarily submitted by Users. We make no warranty as to the accuracy, completeness, or timeliness of such data. Please refer to Section 8 for further details.

3. User Registration and Eligibility

3.1 Eligibility and Age Verification

Browsing and searching the Service are open to users of all ages. However, to use posting features (such as inventory reports), we verify your age via your date of birth at registration.

3.2 Users Under 16 and Parental Consent

Users under the age of 16 must obtain the consent of a parent or legal guardian to use the posting features. At registration, we send a consent confirmation email to the parent's email address, and posting features are enabled once the parent consents. Until consent is obtained, the user may browse and search but cannot post.

For users aged 16 to 17, we also recommend use under the supervision of a parent or legal guardian.

By using the Service, parents and guardians agree to be responsible for:

Supervising the user's service activity
Preventing inappropriate posts and conduct
Managing account information and privacy settings

3.3 Responsibility at Account Creation

Users (and their parents or guardians) are responsible for:

Providing accurate information
Managing their password securely
Reporting any unauthorized use or security concerns

3.4 One Account Per User

Creating multiple accounts is prohibited. Multiple accounts used for abusive or deceptive purposes may all be suspended or deleted.

3.5 Target Region

The Service is provided for residents of Japan. Account registration and posting features are limited to users accessing from within Japan who reside in Japan. Browsing and searching inventory information are available to everyone regardless of location.

3.6 Exclusion of Anti-Social Forces

You represent and warrant that you are not a member of, and have no relationship with, organized crime groups or other anti-social forces (bōryokudan and related entities). If we determine that you have breached this representation, we may suspend or delete your account without prior notice.

4. User Responsibilities

4.1 Password Security

You are solely responsible for all activity conducted through your account. Keep your password confidential and do not share it with any third party. We recommend using a strong, unique password and changing it periodically.

4.2 Reporting Unauthorized Use

If you discover unauthorized access to your account or any violation of these Terms by another User, please notify us immediately at support@everbundance.com.

4.3 Account Deletion

If you wish to delete your account, you may do so through your account settings or by contacting our support team. Upon deletion, you are immediately signed out and your posts are no longer publicly visible. Your personal information and posted content are permanently deleted after a limited retention period (see Privacy Policy Sections 8 and 9).

5. User-Submitted Content

5.1 Definition of User Content

"User Content" means all data, information, or material you post, submit, or share through the Service, including but not limited to:

Inventory reports (e.g., "In Stock," "Sold Out," "Discontinued")
Store information additions or corrections
Reviews and comments
Photos and images

5.2 User Responsibility

You are solely responsible for your User Content. We have no obligation to monitor or pre-screen User Content and accept no liability for its accuracy, legality, or appropriateness.

5.3 Intellectual Property Compliance

You must not post content that infringes the copyright, portrait rights, trademark rights, or privacy of any third party. You are responsible for ensuring that you hold the necessary rights or permissions for any content you submit.

5.4 Right to Remove Content

We reserve the right to remove any User Content that violates these Terms or that we deem harmful, inappropriate, or false, without prior notice and without obligation to compensate the submitting User.

6. Intellectual Property Rights

6.1 Our Intellectual Property

All intellectual property rights in and to the Service—including its logos, designs, trademarks, software, text, and images (excluding User Content)—belong to Everbundance or its licensors.

6.2 License from Users

You retain ownership of your User Content. By submitting User Content to the Service, you grant Everbundance the following license:

Type: Non-exclusive, sublicensable
Compensation: Royalty-free
Duration: For as long as the content remains on the Service. Upon account deletion, your posted content is deleted in accordance with Privacy Policy Section 8; however, statistical information derived from posts that identifies neither any individual nor any individual post may continue to be used after deletion
Permitted uses:
- Operating and delivering the Service
- Improving and developing new features
- Marketing and promotional activities
- Anonymized statistical analysis

6.3 Third-Party Sharing

Where User Content contains personal data, we will obtain your prior consent in accordance with our Privacy Policy before providing it to any third party, except where disclosure is required by law. The provision of statistical information or anonymously processed information that does not identify any individual is governed by Privacy Policy Section 10.

6.4 Restrictions

These Terms do not grant you any right to copy, modify, distribute, decompile, or reverse-engineer any part of Everbundance's intellectual property.

7. Prohibited Conduct

Users must not engage in any of the following activities:

Spam and false inventory reports: Intentionally submitting incorrect inventory information, or submitting large volumes of duplicate or meaningless reports
Automated scraping and bot activity: Using bots, scripts, or crawlers to collect data at scale, including for commercial or competitive purposes
Unauthorized commercial use: Extracting store or inventory data from the Service without permission for commercial purposes
Fraud and impersonation: Impersonating other Users, Company employees, or public figures; submitting fraudulent information
Harassment and threats: Harassing, threatening, or discriminating against other Users; sending unsolicited messages
Illegal content: Posting or sharing content that violates applicable law, including material related to child abuse, violence, or controlled substances
Intellectual property infringement: Posting content that infringes the copyright, trademark, or patent rights of any third party
Unauthorized access and attacks: Attempting to breach the Service's security, exploiting vulnerabilities, or conducting SQL injection or other cyberattacks
Service disruption: Sending excessive requests equivalent to a DDoS attack or otherwise interfering with the normal operation of the Service
Privacy violations: Collecting, disclosing, or using other Users' personal information without authorization

Violations may result in suspension or permanent deletion of your account without prior notice.

8. Disclaimer Regarding Data Accuracy

8.1 Limitations of Crowdsourced Data

Important Notice
Inventory and store information on the Service is based on crowdsourced User submissions. We make no warranty, express or implied, as to the accuracy, completeness, or currency of such information.

8.2 User Assumes Risk

Any actions you take based on information provided on the Service—including visiting stores—are taken at your own risk. We are not liable for transportation costs, lost time, or any other damages resulting from inaccurate information.

8.3 Discontinued and Sold-Out Items

Information about discontinued or sold-out products reflects the status at the time of submission only. We recommend confirming directly with the store or manufacturer before making any visit or purchase decision.

8.4 Store Information

The accuracy of store hours, addresses, number of machines installed, and other store details is similarly not guaranteed.

9. Modification and Discontinuation of Service

9.1 Right to Modify

We reserve the right to modify, add, or remove features, functionality, or content of the Service at any time without prior notice.

9.2 Right to Suspend or Terminate

We may temporarily or permanently suspend the Service in the following circumstances:

Scheduled or emergency system maintenance
Technical failures or system outages
Natural disasters or force majeure events
Business decisions
Legal or regulatory requirements
Any other circumstances we deem necessary

9.3 Notice

We will provide advance notice where reasonably practicable via in-app notifications or email. In urgent situations, we may suspend the Service without prior notice. Users are advised to check the Service status periodically.

10. Limitation of Liability

10.1 Scope of Our Liability

If we cause damage to you in connection with your use of the Service through our willful misconduct or negligence, we will be liable for compensation in accordance with this Section. We are not liable for damages not attributable to us, such as those arising from errors in crowdsourced data (see Section 8), failures of your network environment or device, or the acts of third parties.

10.2 Liability Cap

Where we are liable for damages, except in cases of our willful misconduct or gross negligence, our liability is limited to direct and ordinary damages actually incurred, up to a maximum of JPY 10,000.

10.3 Exception

The limitation in the preceding paragraph does not apply to damages caused by our willful misconduct or gross negligence, or to any liability that may not be limited under applicable law.

11. General Provisions

11.1 Amendments to These Terms

These Terms constitute standard terms of contract (teikei yakkan) under Article 548-2 of the Japanese Civil Code. We may amend these Terms without obtaining individual consent from Users, in accordance with Article 548-4 of the Civil Code, where:

The amendment is in the general interest of Users; or
The amendment is consistent with the purpose of these Terms and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other relevant circumstances.

When amending these Terms, we will announce the amended content and its effective date a reasonable period in advance (at least 30 days in advance for material changes) via in-app announcement or email to your registered address.

11.2 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the agreement between you and Everbundance with respect to your use of the Service. Matters not addressed in these Terms shall be governed by Japanese law and general practice.

11.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.4 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.5 Prerequisite for Use

If you do not agree to these Terms, you may not use the Service.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict-of-law principles.

12.2 Exclusive Jurisdiction

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

12.3 Dispute Resolution Process

In the event of a dispute, the parties shall first attempt to resolve it through good-faith negotiation. If negotiation fails, the parties are encouraged to pursue arbitration or alternative dispute resolution (ADR) before initiating litigation. Each party shall bear its own legal fees.
